Terms of Service

These Terms of Service ("Terms") govern your use of the MamaHearth Cleaning website (mamahearth.com) and any cleaning services we provide ("Services"). By booking, accessing, or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our website or book our Services.

1. About us

MamaHearth Cleaning ("MamaHearth," "we," "us," "our") is a residential cleaning company based in Austin, Texas. We provide standard cleaning, deep cleaning, move-in/move-out cleaning, and recurring home cleaning services to households in the greater Austin area.

2. Eligibility

You must be at least 18 years old and have the legal authority to enter into a binding contract to book our Services. By placing a booking, you confirm that you are the owner or authorized occupant of the property to be cleaned, or that you have the owner's permission to schedule cleaning at the address.

3. Bookings & scheduling

  • Bookings can be made through our website, by phone, or by email.
  • A booking is confirmed once you receive an email or SMS confirmation from us.
  • Arrival times are estimates. We may arrive within a one-hour window of the scheduled start time due to traffic, weather, or earlier appointments running long.
  • You agree to provide accurate information about your home (size, number of rooms, pets, access instructions) at the time of booking. Incorrect information may affect pricing, duration, and the team's ability to deliver the Service.

4. Pricing & payment

  • Pricing is presented as a flat rate for the Service selected and is shown clearly at checkout.
  • Additional requests (extra rooms, deep-clean add-ons, oven, fridge, inside windows, etc.) may incur additional charges. These will be communicated to you before work begins.
  • Payment is processed securely through Shopify Payments and/or Stripe. We accept major credit and debit cards.
  • Recurring service plans are billed automatically per visit, on the date of service.
  • All prices are in U.S. dollars and exclude any applicable taxes.

5. Cancellations & rescheduling

  • You may cancel or reschedule any booking free of charge up to 24 hours before the scheduled start time.
  • Cancellations made within 24 hours of the appointment are subject to a $50 late cancellation fee.
  • If our team arrives and cannot access the property ("lockout"), a fee equal to 50% of the booking total will be charged.
  • MamaHearth reserves the right to cancel or reschedule a booking due to weather, illness, safety concerns, or unforeseen circumstances. In such cases, you will be offered a new appointment or a full refund.

6. Access to your home

You agree to provide safe and timely access to your home at the scheduled appointment time. This may include leaving a key, providing a door code, meeting our team at the door, or arranging access through a building manager. You are responsible for ensuring pets are safely contained and that the home is reasonably free of hazards (excessive clutter, biohazards, pests, unsafe wiring, etc.).

7. Scope of service

Each Service includes the tasks described on our pricing page. Tasks outside that scope (such as biohazard cleanup, mold remediation, heavy lifting, exterior windows above the first floor, post-construction debris, or pest infestations) are not included and may be declined at our discretion.

Our cleaners are trained professionals but are not licensed contractors or handymen. We will not attempt repairs, electrical work, or anything outside the scope of standard residential cleaning.

8. Satisfaction guarantee

If you are not satisfied with any area we cleaned, please notify us within 24 hours of the service. We will return to re-clean the affected area at no additional charge. Refunds are issued only at our discretion, and only when re-cleaning is not possible.

9. Damages & liability

  • All MamaHearth cleaners are background-checked, trained, and covered by liability insurance.
  • If we damage an item during a cleaning, please notify us within 48 hours with photos. We will repair or replace the item up to a reasonable fair market value.
  • We are not liable for: pre-existing damage, normal wear and tear, items that were already broken or improperly secured, damage to fragile items not disclosed in advance, or items of extraordinary sentimental or monetary value left unsecured.
  • Our total liability for any claim is limited to the amount you paid for the Service in question.

10. Items of high value

To avoid accidents, please secure or remove cash, jewelry, firearms, irreplaceable documents, fragile heirlooms, and other items of significant value before our team arrives. We are not responsible for the loss or damage of unsecured high-value items.

11. Right to refuse service

MamaHearth reserves the right to refuse or terminate Service if:

  • The environment is unsafe for our team (biohazards, pests, weapons, intoxication, harassment, etc.).
  • The work requested falls outside our scope or skill set.
  • A customer behaves abusively, threateningly, or discriminatorily toward our staff.
  • An account has unpaid invoices or repeated chargebacks.

12. Non-solicitation

You agree not to directly hire, employ, or contract any current or former MamaHearth team member for private cleaning work for a period of 12 months following their last assignment at your home, without our written consent. If you do, a placement fee of $2,500 applies, payable on demand.

13. Intellectual property

All content on mamahearth.com — including text, graphics, logos, photos, and the MamaHearth name — is the property of MamaHearth Cleaning or its licensors and is protected by U.S. and international copyright and trademark laws. You may not copy, reproduce, or use any of this content for commercial purposes without our prior written permission.

14. Acceptable use of the website

You agree not to use our website to:

  • Violate any applicable law or regulation.
  • Submit false, misleading, or fraudulent information.
  • Attempt to gain unauthorized access to any portion of the site or its systems.
  • Interfere with or disrupt the integrity or performance of the site.
  • Use the site to harass, harm, or impersonate any person.

15. Reviews & feedback

If you submit a review, testimonial, or feedback, you grant MamaHearth a non-exclusive, royalty-free, worldwide license to use, display, and reproduce that content for marketing and promotional purposes, with attribution by first name and last initial only.

16. Disclaimers

Our website and Services are provided "as is" and "as available," without warranties of any kind, either express or implied. We do not guarantee that the website will be uninterrupted, error-free, or completely secure. To the maximum extent permitted by law, we disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

17. Limitation of liability

To the maximum extent permitted by law, MamaHearth Cleaning, its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, or loss of goodwill — arising out of or related to your use of the website or Services. Our total aggregate liability for any claim is limited to the greater of (a) the amount you paid for the Service giving rise to the claim, or (b) one hundred U.S. dollars ($100).

18. Indemnification

You agree to indemnify and hold harmless MamaHearth Cleaning, its owners, employees, and contractors from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the Services, or your violation of any third-party rights.

19. Governing law & disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Services will be resolved exclusively in the state or federal courts located in Travis County, Texas. You and MamaHearth each waive any objection to jurisdiction and venue in those courts.

20. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top will reflect the most recent revision. Material changes will be communicated by email or by a notice on the website. Continued use of the Services after changes take effect constitutes acceptance of the new Terms.
